General Terms and Conditions for the Provision of Services

Health Tests OÜ (www.terviseuuringud.ee)

1. PARTIES TO THE AGREEMENT

1.1

These General Terms and Conditions of Health Tests OÜ govern the mutual rights and obligations of the Client and Health Tests OÜ in connection with the provision of healthcare and health services to the Client by Health Tests OÜ.


1. GENERAL PROVISIONS

1.1

These General Terms and Conditions of Health Tests OÜ (hereinafter “Health Tests”) apply to all healthcare and health services provided by Health Tests (hereinafter the “Service”), unless the application of the General Terms is expressly excluded. The General Terms form an integral part of all agreements entered into between Health Tests and the Client.

1.2

An integral part of these General Terms are the personal data processing privacy terms (hereinafter the “Privacy Policy”), which are presented to the Client together with the General Terms.

1.3

For the provision of the Service, Health Tests and the Client enter into an agreement (hereinafter the “Agreement”), under which Health Tests undertakes to provide the agreed Service to the Client, and the Client undertakes to pay for the Service in accordance with the Agreement and to provide all necessary cooperation to ensure proper service delivery. The services offered by Health Tests are listed on the website www.terviseuuringud.ee and may change over time.


2. CONCLUSION OF THE AGREEMENT

2.1

The Agreement is deemed concluded between Health Tests and the Client from the moment the Client expresses the wish to register for an appointment. From that moment, the General Terms and the Privacy Policy apply to the Client.

The Client may register for an appointment:

Health Tests will book the first available appointment or, at the Client’s request, a later available time.

2.4

Registration for a Service is deemed as the Client’s consent to the provision of the Service.

2.5

Health Tests provides services in Estonian. If the healthcare or health professional providing the Service speaks another language understood by the Client and the Client wishes the Service to be provided in that language, the Service may be provided accordingly.

2.6

The Client understands that high-quality service delivery is possible only if the Client cooperates, actively participates in the Service, fulfils contractual obligations, and follows instructions given by Health Tests staff. Health Tests does not guarantee the success of the Service or that the result will fully meet the Client’s expectations (Law of Obligations Act § 766 (2)).


3. RIGHTS AND OBLIGATIONS OF HEALTH TESTS

3.1 Health Tests has the right to:

  • request truthful and complete information about the Client’s health condition;

  • establish internal rules regulating Client behaviour at Health Tests premises and require compliance;

  • change a booked appointment for organisational or other reasons;

  • receive payment for the Service.

3.2 Health Tests undertakes to:

  • provide the Service in accordance with generally accepted medical standards (or rehabilitation and physiotherapy standards, where applicable) and applicable legislation;

  • inform the Client of examination results, health condition, possible diagnoses, service availability, purpose, risks, consequences, and alternative services, and provide such information in written form upon request;

  • maintain confidentiality of the Client’s personal and health data;

  • properly document the Service and store documentation in accordance with legal requirements.


4. RIGHTS AND OBLIGATIONS OF THE CLIENT

4.1 The Client has the right to:

  • receive the Service;

  • receive information about the nature, risks, and alternatives of the Service;

  • receive information about examination results and health status;

  • participate in decision-making related to the Service and give or refuse consent;

  • demand confidentiality of health and personal data unless disclosure is required by law;

  • designate persons entitled to receive information about their health;

  • cancel a booked outpatient appointment without stating a reason no later than one working day before the appointment;

  • review documentation related to the Service and obtain copies at their own expense.

4.2 The Client undertakes to:

  • disclose all information necessary for the provision of the Service and cooperate fully;

  • provide truthful and complete information about their health, prior treatments, and medications;

  • pay for the Service in accordance with the Agreement and these General Terms;

  • arrive on time with valid photo identification;

  • follow all instructions given during Service provision;

  • promptly inform Health Tests of any complications and attend follow-up consultations if necessary;

  • comply with internal rules and respect the rights of other Clients.


5. CLIENT CONSENT

5.1

The Client may be examined and provided with the Service only with informed consent, preceded by information about the nature and risks of the Service. Health Tests may request health data during or prior to service delivery. The Client is responsible for the accuracy of the provided information.

5.2

The Client may withdraw consent within a reasonable time after giving it, using the same form in which consent was provided.

5.3

If the Client refuses to receive information about examination results or health condition, Health Tests shall not disclose such information unless non-disclosure would harm the Client or third parties. Refusal may be required in written form.


6. PRIVACY AND DATA PROTECTION

6.1

Health Tests processes personal data in accordance with applicable law and solely for service provision and related documentation. Data is disclosed to third parties only with Client consent or as required by law.

6.2

Health Tests and all involved personnel must maintain confidentiality of all personal and health-related data, unless disclosure is consented to or legally required.

6.3

Personal data processing is additionally governed by the Privacy Policy.


7. FEES

7.1

The Client must pay for the booked or agreed Service in advance or no later than on the day of Service provision.

7.2

Unless otherwise agreed in writing, prices are determined according to the price list valid at the time of service provision, available at Health Tests premises and on www.terviseuuringud.ee. Additional procedures or analyses are charged separately.

7.3

Health Tests may unilaterally amend the price list with future effect.


8. LIABILITY

8.1

Health Tests and service providers are liable only for culpable breach of obligations.

8.2

Health Tests is not liable for indirect or non-material damage.

8.3

Health Tests’ liability is limited to three times the amount paid under the Agreement.

8.4

Health Tests is not liable if damage results from the Client’s failure to follow instructions.

8.5

Failure to attend an appointment without notice is considered a material breach.

8.6

The Client bears the burden of proof, except where documentation is insufficient.

8.7

Liability limitations do not apply in cases of intentional misconduct.

8.8

Claims expire five years from the time the Client became aware of the breach and damage.

8.9

Health Tests may charge a contractual penalty equal to 80% of the Service price for no-shows without proper notice.


9. TERMINATION OF THE AGREEMENT

9.1

The Agreement ends upon completion of the Service and related follow-up obligations.

9.2

The Agreement may also end upon transfer of care or termination by either party.

9.3

The Client may terminate the Agreement at any time. Late cancellation may result in partial compensation.

9.4

Health Tests may terminate or postpone the Service for justified reasons, including non-payment, breach of obligations, intoxication, or medical considerations.

9.5

Termination does not release the Client from payment obligations.

9.6

Termination does not affect the validity of clauses 6–9.


10. FINAL PROVISIONS

10.1

Estonian law applies to the Agreement.

10.2

Complaints may be submitted to info@terviseuuringud.ee and will be reviewed within a reasonable time.

10.3

The Client may exercise statutory remedies for non-compliance.

10.4

Health Tests does not provide a service guarantee (Law of Obligations Act § 766 (2)).

10.5

Rights and obligations may not be assigned without written consent, except for debt collection.

10.6

Amendments must be in writing. Health Tests may amend the General Terms unilaterally; amendments take effect upon publication.

10.7

Invalidity of one provision does not affect the validity of others.

Disputes shall be resolved through negotiations; failing that, in Harju County Court.
